Terms of Service

These Terms of Service ("Terms") govern access to and use of FitRum AI Virtual Try-On ("FitRum", "the App", "we", "us", or "our"). By installing or using FitRum, you agree to these Terms.

FitRum support writes only from [email protected]. Any other email or person claiming to represent FitRum support should be treated as fraudulent.

1. The Service

FitRum is a Shopify app that lets merchants add AI virtual try-on functionality to selected products. Shoppers can upload a photo, give consent, and generate a preview of how a product may look on them.

AI-generated previews are visual estimates. They may not perfectly represent real-world fit, size, color, texture, or appearance.

2. Eligibility

To use FitRum, you must:

  • Be a Shopify merchant or authorized representative of a Shopify merchant.
  • Be at least 18 years old.
  • Have authority to install apps, approve billing, and manage storefront content for the store.
  • Comply with Shopify's terms and all laws that apply to your store.

3. Merchant Responsibilities

You are responsible for:

  • Choosing which products use FitRum.
  • Making sure product images and content are lawful and owned or licensed by you.
  • Showing required privacy notices to shoppers.
  • Collecting any required consent before shoppers upload photos or provide emails.
  • Using shopper emails only as allowed by consent and applicable law.
  • Not using FitRum for unlawful, deceptive, harmful, explicit, discriminatory, or abusive content.
  • Not attempting to bypass app limits, security controls, billing flows, or Shopify requirements.

4. Shopper Photos and Generated Results

Shopper photos are processed only to provide requested try-on previews and related safety checks. Generated results are for preview and store experience purposes only.

You must not use a shopper's uploaded photo or generated result for advertising, social media, product listings, or other public marketing unless you have obtained all required rights and consent from that shopper.

5. AI Output

AI output may be inaccurate, incomplete, delayed, or unavailable. FitRum does not guarantee that a generated preview will match the actual product, body fit, measurements, color, lighting, or final purchase experience.

You remain responsible for your product descriptions, sizing guidance, return policy, and customer communications.

6. Billing

Paid plans, free plans, subscription changes, and usage-based charges are processed through Shopify Billing. Plan features, included try-ons, prices, and overage limits are shown in the App and may also appear in the Shopify App Store listing.

When you approve a paid plan or usage charge through Shopify, you authorize Shopify to bill your store according to the approved terms.

Refunds are handled through Shopify and may be granted at our discretion where appropriate. Consumed usage charges are generally not refundable unless required by law or Shopify policy.

7. Data and Privacy

FitRum processes data according to our Privacy Policy and, where applicable, our Data Processing Agreement.

We do not sell personal data. We do not use shopper photos to train AI models. We process Shopify privacy webhooks and deletion requests according to Shopify requirements and applicable law.

8. Security and Abuse Prevention

FitRum may limit, delay, block, or suspend requests that appear abusive, fraudulent, automated, unsafe, or likely to harm the service, merchants, shoppers, or third parties.

We may also remove access to features, temporarily disable generation, or suspend a store if continued use creates legal, security, billing, or platform risk.

9. Intellectual Property

FitRum and its software, design, documentation, workflows, and technology are owned by us or our licensors.

You keep ownership of your store content and product images. Shoppers keep any rights they have in their uploaded photos. You grant FitRum the limited rights needed to operate the App for your store.

10. Availability

We work to keep FitRum available and reliable, but the App may sometimes be unavailable because of maintenance, network issues, Shopify platform behavior, third-party service interruptions, abuse controls, or events outside our control.

11. Termination

You may stop using FitRum by uninstalling the App from Shopify. We may suspend or terminate access if you violate these Terms, create risk for shoppers or merchants, fail to pay approved charges, or if Shopify or the law requires it.

After uninstall or termination, we will delete, anonymize, or retain data as described in the Privacy Policy and as required by law.

12. Disclaimers

FitRum is provided on an "as is" and "as available" basis. To the fullest extent allowed by law, we disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted operation, and error-free results.

13. Limitation of Liability

To the fullest extent allowed by law, FitRum will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, loss of goodwill, data loss, or business interruption.

To the fullest extent allowed by law, our total liability for claims relating to FitRum is limited to the amount you paid for the App during the 12 months before the event giving rise to the claim.

14. Indemnification

You agree to defend and hold FitRum harmless from claims, losses, damages, liabilities, and expenses arising from your store content, your products, your use of FitRum, your violation of these Terms, your violation of law, or your handling of shopper data.

15. Changes to These Terms

We may update these Terms from time to time. The "Last updated" date will show the latest version. Continued use of FitRum after changes take effect means you accept the updated Terms.

Stay Safe from Fraud

Our official support team communicates exclusively from [email protected]. Any other email address claiming to represent Fitrum is fraudulent. We will never ask for your password, payment details, or store credentials via email.
